These Terms of Service ("Terms") govern your use of the Raleigh EcoPallet website at raleigh-ecopallet.com ("Website") and the products and services offered by Raleigh EcoPallet ("Company," "we," "our," or "us"). By accessing our website or purchasing our products and services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using the Raleigh EcoPallet website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

2. Description of Services

Raleigh EcoPallet provides the following products and services:

• Sale of used wood pallets in various sizes and grades (A, B, and C)
• Sale of new wood pallets and plastic pallets
• Custom pallet fabrication to customer specifications
• Pallet repair and restoration services
• Pallet recycling and take-back programs
• Pallet transport and logistics services
• ISPM-15 heat treatment for international shipping compliance
• Pallet management programs and consultation
• Pallet accessories and related products

All services are subject to availability and may vary based on location, current inventory levels, market conditions, and other factors. We reserve the right to modify, suspend, or discontinue any service at any time.

3. Product Descriptions and Grading

We make every effort to accurately describe our products, including pallet grades, dimensions, and conditions. Our grading system (Grade A, Grade B, Grade C) is described in detail on our Pallet Grading Guide page. Key points:

• Used pallets are pre-owned products. Minor variations in appearance, color, and surface condition are normal and expected within each grade.
• Grade descriptions serve as general guidelines. Individual pallets may vary slightly within the stated grade characteristics.
• Pallet dimensions are subject to standard manufacturing and wear tolerances (typically plus or minus 1/4 inch for standard sizes).
• Load capacity ratings are for pallets in the stated grade condition. Actual capacity may vary based on load distribution, environmental conditions, and usage.
• Photos on our website are representative and may not depict the exact pallets you will receive.

4. Pricing and Payment

Pricing for our products and services is subject to the following terms:

• All prices are quoted in US dollars and are subject to change based on market conditions, inventory levels, lumber costs, and order specifications.
• Quotes are valid for 7 business days from the date of issuance unless otherwise stated in writing.
• Volume discounts are available and are calculated based on the total quantity per order or per contract period.
• Delivery fees, if applicable, are quoted separately and included in the total price before order confirmation.
• Payment terms are established at the time of order confirmation and may include prepayment, net-30, or other arrangements based on credit approval.
• Late payments may be subject to a service charge of 1.5% per month (18% annually) on outstanding balances.
• All sales are final once the order has been confirmed and fulfilled, subject to our returns policy.

5. Orders and Fulfillment

Orders are considered confirmed upon receipt of written approval (email, signed quote, or purchase order) from the customer and, where required, receipt of payment. We will make commercially reasonable efforts to fulfill confirmed orders within the stated timeframe. However, fulfillment timelines are estimates and are not guaranteed. Circumstances beyond our control, including supply chain disruptions, weather events, equipment failures, or unexpected demand, may affect delivery timelines. We will communicate any delays promptly. We reserve the right to decline or cancel any order at our discretion, in which case any prepayment will be fully refunded.

6. Delivery Terms

Delivery of pallets and related products is subject to the following terms:

• Delivery timelines are estimates and may vary based on availability, distance, weather, and logistics conditions.
• We are not liable for delays caused by circumstances beyond our reasonable control.
• The customer is responsible for providing adequate, safe, and accessible space for delivery vehicles at the delivery location.
• Risk of loss and title to products passes to the customer upon delivery at the designated location or upon loading at our facility for customer pickups.
• The customer should inspect delivered pallets promptly upon receipt. Any claims for incorrect grades, quantities, or damaged pallets must be reported within 48 hours of delivery.
• Delivery to locations with access restrictions (low clearance, narrow roads, weight-restricted bridges, etc.) must be communicated at the time of ordering.

7. Customer Pickup

Customers choosing to pick up orders from our facility must schedule a pickup time in advance. Orders will be staged and ready for loading at the scheduled time. The customer is responsible for providing appropriate transportation and securing the load for transit. All pickups must be completed within 5 business days of notification that the order is ready. Orders not picked up within this period may be subject to storage fees or restocking. Risk of loss passes to the customer at the time of loading at our facility.

8. Returns, Refunds, and Exchanges

Due to the nature of used pallet products, our return policy is as follows:

• If delivered pallets do not match the ordered grade or size, contact us within 48 hours of delivery. We will arrange replacement or issue a credit at our discretion.
• Pallets must not have been used, modified, or damaged by the customer to be eligible for return or exchange.
• Returns of pallets that match the ordered specifications are accepted at our discretion and may be subject to a restocking fee of 15-25% of the order value.
• Custom-ordered pallets (non-standard sizes, special construction, or branded pallets) are non-returnable unless defective.
• Refunds, when approved, will be issued using the original payment method within 14 business days.

9. Pallet Condition Guarantees

We guarantee that every pallet sold by Raleigh EcoPallet has been inspected according to our published inspection process and meets the characteristics described for its assigned grade. Specifically: Grade A pallets will be in excellent condition with no broken boards, no protruding nails, and minimal cosmetic wear. Grade B pallets will be structurally sound with full load capacity, though they may have minor cosmetic imperfections or professionally repaired boards. Grade C pallets will be structurally functional for their intended applications, though they may show significant wear and multiple repairs. All grades are guaranteed to be free from contamination, mold, and pest infestation at the time of sale. If any pallet does not meet these standards, we will replace it at no cost.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Raleigh EcoPallet shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our products or services, including but not limited to: loss of profits, loss of business, damage to goods transported on our pallets, business interruption, or costs of substitute products. Our total liability for any claim arising from the sale of products or provision of services shall not exceed the amount paid by the customer for the specific product or service that is the subject of the claim. This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise).

11. Indemnification

You agree to indemnify, defend, and hold harmless Raleigh EcoPallet, its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: your use of our products or services, your violation of these Terms, your violation of any applicable law or regulation, or any injury or damage caused by your use, modification, or handling of pallets purchased from us. This indemnification obligation survives the termination of these Terms and the completion of any transaction.

12. Intellectual Property

All content on this website, including but not limited to text, articles, guides, images, logos, icons, design elements, and the overall layout and presentation, is the property of Raleigh EcoPallet and is protected by applicable intellectual property laws, including copyright and trademark law. You may not reproduce, distribute, modify, display, create derivative works from, or otherwise use our content without our prior written permission. Limited exceptions include: sharing links to our articles and pages, printing individual pages for personal or internal business reference, and quoting brief excerpts with proper attribution.

13. Dispute Resolution

In the event of any dispute arising from or related to these Terms or our products and services, the parties agree to the following resolution process:

1. Informal Resolution: The parties shall first attempt to resolve the dispute through good-faith negotiation. Either party may initiate this process by providing written notice to the other party describing the dispute.
2. Mediation: If informal negotiation does not resolve the dispute within 30 days, either party may request mediation through a mutually agreed-upon mediator in Wake County, North Carolina.
3. Litigation: If mediation does not resolve the dispute, either party may pursue resolution through the courts of Wake County, North Carolina.

14. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes become effective when posted on this page with an updated "Last updated" date. For material changes that significantly affect your rights or obligations, we will make reasonable efforts to provide notice through our website. Your continued use of our website or services after any modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in Wake County, North Carolina, and you consent to the jurisdiction of such courts.
